Whilst you're enjoying the Cupidity mobile application ("App"), we collect some information about you. In addition, you may choose to use the App to share information with other members, including your friends and contacts ("Users"). We may also need to share your information sometimes.
Cupidity is a global app, and your information will be sent to and used in India regardless of the country you reside in. This Policy explains how we protect your personal data when we transfer it overseas, so please read very carefully!
1. Where This Privacy Policy Applies : This Privacy Policy applies to websites, apps, events and other services operated by Cupidity. For simplicity, we refer to all of these as our “services” in this Privacy Policy. To make it extra clear, we’ve added links to this Privacy Policy on all applicable services. Some services may require their own unique privacy policy. If a particular service has its own privacy policy, then that policy -- not this Privacy Policy -- applies.
Data Storage : By using the App, you acknowledge that Cupidity is a global app operating through servers located in a number of countries around the world, including the United States. If you live in a country with data protection laws, the storage of your personal data may provide you with the same protections as you enjoy in your country of residence.
2. Collection Of Information: When you download the App and create an account ("Account"), we may collect certain information ("Registration Information") about you, such:
•Name
•Email address
•Mobile number
•Gender identity
•Age
•Sexual preference
•Photographs
•Login information and friend lists for social media accounts that you connect to your Cupidity Account (this could include, for example, your Facebook and Instagram accounts ("Social Media Accounts").
You can change your gender identity and preferences at anytime by accessing “Edit bio” page.
Additional Information: We may also collect additional information in connection with your use of Cupidity, for example if you use our super cool electronic messaging function.
If you contact our Customer Support team, we will receive your email address, and may track your IP address as well as the information you send to us to help resolve your query. We will keep records of our communications with you, including any complaints that we receive from you about other Users (and from other Users about you).
We recommend and encourage you (and all our members) to think carefully about the information you disclose about yourself. We also do not recommend that you put email addresses, URLs, instant messaging details, phone numbers, full names or addresses, credit card details, national identity numbers, drivers' licence details and other sensitive information on your profile which is open to abuse and misuse. Please be careful about posting sensitive details about yourself on your profile.
Please remember that photographs that you post on Cupidity may reveal information about yourself as well. Where you do upload and choose to tell us sensitive information about yourself, including through adding certain Badges to your profile, you are explicitly consenting to our processing of your information and making this public to other users.
When you post information about yourself or use the messaging function, the amount of personal information you share is at your own risk. We collect information about your activity on our services, for instance how you use them (e.g., date and time you logged in, features you’ve been using, searches, clicks and pages which have been shown to you, referring webpage address, advertising that you click on) and how you interact with other users (e.g., users you connect and interact with, time and date of your exchanges, number of messages you send and receive).
3. How We Use Information :The main reason we use your information is to deliver and improve our services. Additionally, we use your info to help keep you safe and to provide you with advertising that may be of interest to you. Read on for a more detailed explanation of the various reasons we use your information, together with practical examples.
•Create and manage your account.
•Provide you with customer support and respond to your requests
•Analyze your profile, activity on the service, and preferences to recommend meaningful connections to you and recommend you to others.
•Show users’ profiles to one another
•Link the various devices you use so that you can enjoy a consistent experience of our services on all of them. •Register you and display your profile on new Cupidity features and apps
•Administer your account on these new features and apps
•Administer focus groups and surveys
•Conduct research and analysis of users’ behavior to improve our services and content (for instance, we may decide to change the look and feel or even substantially modify a given feature based on users’ behavior)
•Develop new features and services (for example, we may decide to build a new interests-based feature further to requests received from users).
•Address ongoing or alleged misbehavior on and off-platform
•Perform data analysis to better understand and design countermeasures against these activities
•Retain data related to fraudulent activities to prevent against recurrences

•Enforce or exercise our rights, for example our Terms
•Provide our service to you: Most of the time, the reason we process your information is to perform the contract that you have with us. For instance, as you go about using our service to build meaningful connections, we use your information to maintain your account and your profile, to make it viewable to other users and recommend other users to you.
•Legitimate interests: We may use your information where we have legitimate interests to do so. For instance, we analyze users’ behavior on our services to continuously improve our offerings, we suggest offers we think might interest you, and we process information for administrative, fraud detection and other legal purposes.
•Consent: From time to time, we may ask for your consent to use your information for certain specific reasons. You may withdraw your consent at any time by contacting us at the address provided at the end of this Privacy Policy.

Cookies : Cookies are small data files that are transferred to your computer's hard disk and are basically a tool that stores information about website visits, recognises you and your preferences each time you visit Cupidity, and ensures site functionality and enables us to provide the services our members request.

5. How We Share Information: Since our goal is to help you make meaningful connections, the main sharing of users’ information is, of course, with other users.
You share information with other users when you voluntarily disclose information on the service (including your public profile). Please be careful with your information and make sure that the content you share is stuff that you’re comfortable being publicly viewable since neither you nor we can control what others do with your information once you share it.
We may transfer your information if we are involved, whether in whole or in part, in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control.
We may disclose your information if reasonably necessary:
(i) To comply with a legal process, such as a court order, subpoena or search warrant, government / law enforcement investigation or other legal requirements;
(ii) To assist in the prevention or detection of crime (subject in each case to applicable law);
or
(iii) To protect the safety of any person.

(ii) As necessary to protect our legal rights and legal rights of our users, business partners or other interested parties;

If you live in a country with data protection laws, the storage of your personal data may not provide you with the same protections as you enjoy in your country of residence.
We keep your personal information only as long as we need it for legitimate business purposes. In practice, we delete or anonymise your information upon deletion of your account.
7. Your Rights : We want you to be in control of your information, so we have provided you with the following tools:
•Access / Update tools in the service: Tools and account settings that help you to access, rectify or delete information that you provided to us and that’s associated with your account directly within the service. If you have any question on those tools and settings, please contact our customer care team for help.
•Device permissions: Mobile platforms have permission systems for specific types of device data and notifications, such as phone book and location services as well as push notifications. You can change your settings on your device to either consent or oppose the collection of the corresponding information or the display of the corresponding notifications. Of course, if you do that, certain services may lose full functionality.
•Deletion: You can delete your account by using the corresponding functionality directly on the service.
We want you to be aware of your privacy rights. Here are a few key points to remember:
•Reviewing your information: Applicable privacy laws may give you the right to review the personal information we keep about you (depending on the jurisdiction, this may be called right of access, right of portability or variations of those terms). You can request a copy of your personal information by putting in such a request.
•Updating your information: If you believe that the information we hold about you is inaccurate or that we are no longer entitled to use it and want to request its rectification, deletion or object to its processing, please contact us.
For your protection and the protection of all of our users, we may ask you to provide proof of identity before we can answer the above requests.
Keep in mind, we may reject requests for certain reasons, including if the request is unlawful or if it may infringe on trade secrets or intellectual property or the privacy of another user. If you wish to receive information relating to another user, such as a copy of any messages you received from him or her through our service, the other user will have to contact our Privacy Officer to provide their written consent before the information is released. Also, we may not be able to accommodate certain requests to object to the processing of personal information, notably where such requests would not allow us to provide our service to you anymore. For instance, we cannot provide our service if we do not have your date of birth.
•Uninstall : You can stop all information collection by an app by uninstalling it using the standard uninstall process for your device. If you uninstall the app from your mobile device, the unique identifier associated with your device will continue to be stored. If you re-install the application on the same mobile device, we will be able to re-associate this identifier to your previous transactions and activities.
•Accountability:In certain countries, including in the European Union, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how we process your personal information. The data protection authority you can lodge a complaint with notably may be that of your habitual residence, where you work or where we are established.
8. Our Policy Towards Age : Our services are restricted to users who are 18 years of age or older. We do not permit users under the age of 18 on our platform and we do not knowingly collect personal information from anyone under the age of 18. If you suspect that a user is under the age of 18, please use the reporting mechanism available through the service.
9. How We Protect Your Information : We work hard to protect you from unauthorized access to or alteration, disclosure or destruction of your personal information. As with all technology companies, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information will always remain secure.
We regularly monitor our systems for possible vulnerabilities and attacks and regularly review our information collection, storage and processing practices to update our physical, technical and organizational security measures.
We may suspend your use of all or part of the services without notice if we suspect or detect any breach of security. If you believe that your account or information is no longer secure, please notify us immediately.
10. How Long We Retain Your Information : There is an outstanding issue, claim or dispute requiring us to keep the relevant information until it is resolved; or
The information must be kept for our legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, information may need to be kept to prevent a user who was banned for unsafe behavior or security incidents from opening a new account.
Keep in mind that even though our systems are designed to carry out data deletion processes according to the above guidelines, we cannot promise that all data will be deleted within a specific timeframe due to technical constraints.
11. Privacy Policy Changes : Because we’re always looking for new and innovative ways to help you build meaningful connections, this policy may change over time. The most recent version will be put up on “Privacy Policy” in settings page. If you continue to use the service after the changes become effective, then you agree to the revised Privacy Policy.
12. Third Party Accounts : If you have registered with Cupidity using a third party social media platform, such as Facebook, your Cupidity profile will be available to all Users of Cupidity whether via our App or our partners' websites.
Remember that when you register with a third party, you are also giving them personal information, so we recommend that you read their privacy policies as Cupidity does not control how they use their information.
If you have registered on one of these third party websites, such as Facebook, or you have verified your Account via a third party website, we may connect your Cupidity profile with your profile on such website. We may do this by way of new products and applications which we introduce from time to time, including new products powered by our group companies.
If you have created a Cupidity profile through a third party website and you do not want to link your Cupidity profile to your profile on the third party website, Cupidity cannot amend these settings. Please visit the application settings on your third party website profile and follow the instructions to remove the Cupidity access permissions.
We only use the APIs, OAuth Tokens, Widgets, or other means provided by the applicable Social Media Account to integrate your Social Media Account with our App. As such, we only receive the limited information that each Social Media Account permits to be transferred.
13. Residents of California : If you are a California resident, you can request a notice disclosing the categories of personal information about you that we have shared with third parties for their direct marketing purposes during the preceding calendar year. To request this notice, please submit your request. Please allow 30 days for a response. For your protection and the protection of all of our users, we may ask you to provide proof of identity before we can answer such a request.

If you do not accept and agree to be bound by all the terms of this Agreement, please do not use the app.
We make changes to the Agreement occasionally for valid reasons, such as improving the existing functions or features, adding new features or functions or removing some features or functions to the service ,reasonable technical adjustments to the service, for legal or regulatory services and ensuring the operability or the security of the app and its features. If we make the changes to these terms, the most recent version will be put up on ‘Terms of Service’ in settings page. If you continue to use the service after the changes become effective , then you agree to the revised Agreement.
3) Limitation of Liability :The service is provided as and to the extent permitted by the law, grants no warranties of any kind ,whether expressed implied statutory or otherwise with respect to the service , Including without limitation ,any implied warranties of satisfactory quality, Merchantability, fitness for a particular purpose or non-infringement.
We also don’t control what people or others do or say and we aren’t responsible for their actions or conduct(whether online or offline) or content(including unlawful or objectionable content). We also aren’t responsible for services and features offered by other people or companies ,even if you access them through our service. You expressly agree that your use of the Cupidity services is at your sole risk .
We can’t guarantee that the service will be safe and secure and work perfectly all the time. Cupidity does not represent and warrant that
1)Any defects or errors in the service will be corrected.
2)That any content or information that you obtain on or through the service will be accurate.
You agree that we won’t be responsible(liable) for any lost profits, revenues, information or data , or consequential, special, indirect , exemplary ,primitive or incidental damage arising out of or correlated to these Terms , even if we know they are possible.
4) Governing Law: With respect to any dispute regarding the service or use of services, all rights and obligations and all actions contemplated by these terms and conditions shall be governed by the law of India without giving effect to any principles of conflict of laws , as if the terms and conditions were a contract wholly entered into and wholly performed within India.
5) Community Rules: By using the service ,you agree that you will Not:
1) Use the service for posting any content that is hate speech, threatening, sexually explicit or Pornographic, incites violence, or contains nudity or graphic
2) Use the service for posting any content that violates or intrigues anyone’s rights ,including rights of publicity, privacy, copyright, trademark or other intellectual property or contract right.
3) Use the service for harassment in any form, this includes stalking , bullying or intimidation or sending any unsolicited sexual content to your matches.
4) Use the service for any purpose that is illegal or prohibited by this agreement.
5) Make a fake account or try and impersonate other person.
6) Use the service for promoting or advocating commercial sexual services, human trafficking or other non-consensual sexual acts is strictly prohibited and will result in your accounts getting banned.
7) Make more than one account for one person or use another member’s account or share an account with another member
8) Use the service for any harmful purpose.
9) Spam, solicit money from or defraud any members.
10) Post any content that promotes racism, bigotry, hatred or physical harm of any kind against any person or individual.
11) Solicit passwords for any purpose or personal identifying information for commercial or unlawful purposes from other members or discriminate another person’s personal information without his or her permission.
6) Eligibility:
• You must be 18 years or older to create an account on Cupidity and use the service
• You must not be prohibited from receiving any aspect of our service under applicable law.
• We must not have previously disabled your account for violation of law or any of our policies.
• You must not be a convicted sex offender.
7) Your access to and use of our Services:
Your access to and use of the services is subjected to these terms and all applicable laws and regulations.
You may not:
• Access or use the services if you are not fully able and legally competent to agree to these Terms.
• Make unauthorized copies , modify, adapt ,translate ,reverse engineer, disassemble ,decompile or create any derivative works of the Services or any content included therein , include any files , tables or documentation (for any portion thereof) or determine or attempt to determine any source code ,algorithms, method or techniques embodied by the services or any derivative works- thereof.
• Distribute licenses, transfer or sell ,in whole or in part , any of the Services or any derivative works thereof.
• Market , rent or lease the Services for a fee or charge or use the services to advertise or perform any commercial solicitation .
• Use the services ,without our express written consent , for any commercial or unauthorized purpose , including communicating or facilitating any commercial advertisement or solicitation or spamming.
8) Interaction with other members: Cupidity is not responsible for the conduct of any members on or off the service. You are solely responsible for your interactions with other members. You understand that Cupidity does not conduct criminal background checks on its members or any other background check of its members . Cupidity makes no representations or warranties as to the conduct of members.
9) Indemnification :
You agree to defend , indemnify and hold us harmless for any loss, damages or costs including reasonable attorneys’ fees resulting from any third party claim, action or demand arising from:
i. Your use of the Site or Site content in violation of any law ,rule ,regulation or these Terms and Conditions,
or
ii. Any part of your user content . You also agree to indemnify us for any loss, damages or costs, including reasonable attorneys’ ,crawlers or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.
10) Intellectual Property: All the content available in the Services , including but not limited to text, graphics, logos, button icon , images ,data compilation ,and software and the compilation and arrangement thereof (collectively, the “content”) is our property or its partners and is protected by Indian & International copyright laws and treaties. Except as required under applicable law, neither the Content nor Trademark nor any portion of the Service may be used, reproduced, duplicated, copied, sold, resold, accessed ,modified or otherwise exploited in whole or in part for any purpose without our prior written consent. request for consent should be directed to us via email .
11) Termination Clause: Not withstanding any of the Terms, Cupidity reserves the right, without notice and its sole discretion, to terminate your license to use the Services and to block or prevent future access to and use of the Services if you violate any of these Terms or Cupidity’s policies. Upon termination , these Terms shall still apply.

13) User generated content: We do not endorse or control the User Content transmitted or posted on the site and therefore we do not guarantee the accuracy, integrity or quality of User Content. You understand that by using the site, you may be exposed to User Content that is offensive, indecent or objectionable to you. Under no circumstance will we be liable in any way for any User Content, including, without limitation, for any errors or omissions in User Content, or any loss or damage of any kind incurred by you as a result of any User Content transmitted, uploaded, posted, e-mailed or otherwise made available via the Service. You hereby waive all rights to any claims against us for any alleged or actual infringement of any proprietary rights, rights of privacy and publicity, moral rights and rights of attribution in connection with User Content. You acknowledge that we have the right (but not the obligation) in our sole discretion to refuse to post or remove any User Content and we reserve the right to change, condense, or delete any User Content. Without limiting the generality of the foregoing or any other provision of these Terms of Service, we have the right to remove the User Content that violates these Terms or is otherwise objectionable and we reserve the right to refuse service and/or terminate accounts without prior notice for any users who violate these Terms or infringe the rights of others. The views expressed by other users on the Service do not in any way represent our views and values. We accept no liability in respect of any content submitted by users and published by us or by authorised third parties.
